Clean Air Act Section 111(d): Legal Foundations, Policy Issues, and How States are Preparing
The Arkansas Department of Environmental Quality and Public Service Commission invited RAP to discuss forthcoming United States Environmental Protection Agency (EPA) regulations on carbon emissions from existing power plants under Section 111(d) of the Clean Air Act. John Shenot, Ken Colburn, and David Farnsworth opened the session with an overview of policy issues and discussed options that states may have for complying with the new regulations. Compliance decisions made by state air regulators are likely to have cross-state effects, thus increasing the need for ongoing dialogues between state air and energy regulators across the Southeast.
